Terms of Service

By accessing or using GovPursuit (the “Service”), operated by OMNIGEIST LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

GovPursuit is an AI-powered platform that helps government contractors discover, evaluate, and respond to federal contract opportunities published on SAM.gov and related sources. Features include opportunity search, AI-driven solicitation analysis, compliance tracking, capture workspace management, and AI-assisted proposal support.

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain multiple free-tier accounts.

The Service offers a free trial tier with limited AI usage and paid subscription tiers with expanded capabilities. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis.
• Subscription fees are billed in advance on a monthly or annual basis.
• You may cancel at any time; access continues through the end of your billing period.
• Refunds are not provided for partial billing periods.

Payment processing is handled by Stripe. By providing payment information, you also agree to Stripe’s Terms of Service.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse-engineer, scrape, or systematically extract data from the Service
• Resell, redistribute, or sublicense access to the Service or its AI outputs
• Submit false or misleading information to manipulate AI analysis
• Exceed usage limits by circumventing rate limits or token budgets
• Use the Service in a way that degrades performance for other users

The Service uses artificial intelligence to analyze solicitations, generate recommendations, and assist with proposal content. You acknowledge that:

• AI outputs are advisory only. You are solely responsible for verifying accuracy and making final business decisions.
• AI analysis may contain errors, omissions, or incomplete interpretations of government solicitations.
• We do not guarantee that AI recommendations will result in contract awards or favorable evaluations.
• AI-generated content should be reviewed by qualified personnel before inclusion in any proposal submission.

The Service aggregates and presents publicly available data from SAM.gov and other federal data sources. We do not guarantee the completeness, timeliness, or accuracy of this data. Official solicitation documents available directly from the issuing agency are always authoritative.

• The Service, its design, code, and branding are the property of OMNIGEIST LLC and are protected by applicable intellectual property laws.
• Content you create within the Service (e.g., notes, proposal drafts, workspace data) remains yours.
• You grant us a limited license to process your content as necessary to provide the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses caused by service interruptions.

To the maximum extent permitted by law, OMNIGEIST LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, contracts, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may suspend or terminate your access to the Service if you violate these Terms or engage in activity that harms the Service or other users. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

These Terms are governed by the laws of the State of Virginia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Virginia.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
